Terms & Conditions


In the following Terms & Conditions:

''Client(s)'' shall mean ''you'' the parties to the contract;

''Event'' shall mean the photo shoot;

''Photographer'' shall mean Chris Seaman/Chris Seaman Photography;

''Products'' shall mean any prints, digital images or any other goods supplied;

''Services'' shall mean photography to be carried out at the venue and any other Service agreed by the Client and Chris Seaman Photography;
 
It is agreed that the Client agrees the following Terms & Conditions, that no modification shall be effective unless agreed by both parties in writing.



Booking Fee

The booking deposit fee must be paid as set out in the pricing schedule.
Both parties acknowledge that the booking deposit fee is non refundable or transferable in the event of a cancellation by the Client.

Payment in full for the Event must be paid before or on the day of the agreed Event date.

Payment to be made by Cash, Cheque (Payable to Chris Seaman) or Bank Transfer. 
Any returned cheques will attract an administration charge of £25.00

Failure to make any payment may result in the cancellation of the Event at the discretion of Chris Seaman Photography.

If any late or deferred payment is agreed by Chris Seaman Photography for the Event and the Event proceeds, the proof images will not be made available to the Client until full payment has been made.

Any Product(s) ordered must be paid for in full before the Product(s) will be delivered.
A 50% deposit for the Products must be paid for at the time of Product(s) ordering. Once the Product(s) order has been placed, a 24 hour period of cancellation or change of the Product(s) will be given. No Product deposit refund will be given after that 24 hour period due to the Client cancelling the Product(s).
Any change in Product(s) ordered after the order has been placed (after the 24 hour period - see above) will be charged to Client, if the Product(s) have already been ordered by the Photographer and placed to a third party and the change(s) cannot be altered, the cost of ALL PRODUCTS ordered will be at the cost of the Client including any part of the order that cannot be changed or altered.



Extra Mileage

An extra charge will be added if the shoot is to take place outside a radius of 25 miles from Milnthorpe, Cumbria. Extra mileage will be charged at 45 pence per mile.



Gift Certificates

If a Gift Certificate is required for any Event t
he full Event fee must be paid in full before any Gift Certificate will be supplied.
Gift Certificates have a twelve month value period from the date on the Gift Certificate, after the twelve month period the Gift Certificate is invalidated & a refund will not be given.
If a Gift Certificate is refunded for any reason by the Photographer, the amount repayable is only the value of the Gift Certificate minus any Booking Fee/Deposit taken at the time of booking.



Licence and coverage

The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. Although every effort will be made to comply with the Clients' requirements, the Photographers' judgment regarding the location, poses and number of photographs taken shall be deemed correct and not subject to dispute.

Whilst the Photographer shall endeavour to fulfil the Clients' requirements, the Photographer cannot be held responsible for non-availability of subjects or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain shots.
 
Any alterations made to the contract by the Clients once the details have been confirmed may only be confirmed at the discretion of the Photographer and should be agreed in writing. Where the Photographer is unable to accommodate alternative arrangements (such as change of venue or date) the Photographer is not liable to compensate the client in any way whatsoever.


Image and reproduction

All prints and presentation sizes quoted are approximate and subject to change at the discretion of the Photographer and may be subject to slight variation. Whilst every effort will be made, the Photographer cannot guarantee exact colour matching and is not held responsible for any colour variation which may occur due to light and location variations.

Due to limitations of computer monitors and variations of computer operating systems, it is understood that images viewed via this method may appear differently according to the specifications of each monitor/computer and that prints may not match images rendered on any particular computer monitor.

Where images are being made available on a USB memory stick or CD/DVD Disk, reasonable steps are taken to ensure compatibility, but you the Client acknowledge that USB memory or Disks may not play on all devices including and not exclusive to computers.


Any Low Resolution images supplied for Social Media purpose are not good enough for printing, these images are for screen viewing only.

No cash alternative will be offered for any free Print or Product(s) offer.


Reorders

All reorders shall be treated as an extension of the contract and no responsibility for any error will be accepted unless orders are provided in writing.


Ownership

All images shall remain the sole property of the Photographer at all times.

Any products ordered will remain the property of the Photographer until full payment is made.


Copyright

Any images (including parts of the image) or copies of images whether stored digitally or otherwise and any computer program including any source of object code, computer files or printed documentation relating to such images are protected by the Copyright and Designs Act 1988 and remain the copyright of the Photographer at all times unless there is express written agreement to the contrary. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of the Photographer.

 
Insurance and Limitations
 
The Photographer will maintain Public Liability at all times. However, in the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract.
 
Neither party shall be liable for any indirect or consequential loss.
 
 
Force Majeure

The due performance of this contract is subject to alteration or cancellation due to a Force Majeure Event. A Force Majeure Event means an event beyond the control of a party, which by its nature could not have been foreseen, was unavoidable, and includes, without limitation, acts of God, storms, floods, fire, sabotage, civil commotion or civil unrest, interference by civil or military authorities, acts of war or armed hostilities, or other national or international calamity or one or more acts of terrorism or failure of energy sources. For the avoidance of doubt, it does not include circumstances where the Photographer attend an Event to perform the Services and any of the Parties fail to attend.


Conduct

It is the responsibility of the Client or Parent/Legal Guardian to ensure the co-operative behaviour of all persons within the Clients party at the Event. Should the Photographer feel unsafe at the contracted Event or be subjected to abuse (for example:
 drunk or abusive behaviour including verbal abuse, violent action against any member present at the Event by any persons with the Client) and the Client cannot control or prevent the situation then the Photographer is entitled to advise the Client of that situation and leave without forfeit on this contract.


Event Cancellation

Where the Photographer has to cancel an Event, due to circumstances beyond their control the full amount of any fee paid by the Client will be re-paid to the Client.

Where it is possible a re-shoot may be arranged (if practicable) however, the Photographer will not be responsible or liable for any additional costs incurred by the Client.

Should the Client wish to cancel the contract at any time, Notice of cancellation must be given in writing to the Photographer. In such circumstances, the client will be liable to pay the Photographer the following sums -
*Any amount already paid by the Photographer for fees involved with the setting up of the Event, including location fees or any props purchased specifically for the Event.
If the Event has been paid for up front by the client, any fee paid for as above* will be taken from the paid amount and only the remaining figure will be re-paid as a refund to the client minus the booking fee/deposit.



Complaints

All complaints should be raised by the Client directly to the Photographer in writing within 14 days of the occurrence which gives rise to the complaint. The Photographer will consider the complaint and shall provide a response to the client within 14 days of receipt of the complaint.


PLEASE NOTE:

Client transport cost to the venue/location are not covered by Chris Seaman Photography.

Any Client under the age of 18 years of age must have a Parent or Guardian present at any Photo Shoot, under no circumstances will the Event proceed without a parent or guardian being present! The parent or guardian will also need to sign the agreement or model release form before any Event will take place.
